0011|     RELATING TO THE GOVERNOR; INCREASING THE GOVERNOR'S SALARY;
    |
0012|     PROVIDING FOR THE AUDIT OF CONTINGENT FUNDS.

0014|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0015|          Section 1.  Section 8-1-1 NMSA 1978 (being Laws 1971,
    |
0016|     Chapter 260, Section 1, as amended) is amended to read:
    |
0017|          "8-1-1.  COMPENSATION OF ELECTIVE STATE OFFICERS.--
    |
0018|               A.  Annual compensation of elective state officers
    |
0019|     shall be paid as follows:
    |
0020|          governor. . . . . . . . . . . . .$[90,000] 150,000
    |
0021|          secretary of state. . . . . . . . . . . . . . . 65,000
    |
0022|          state auditor . . . . . . . . . . . . . . . . . 65,000
    |
0023|          state treasurer . . . . . . . . . . . . . . . . 65,000

    |
0002|               B.  Any person succeeding to the office of governor
    |
0003|     as provided in Article 5, Section 7 of the constitution of New
    |
0004|     Mexico shall receive the salary of the office.  Every person
    |
0005|     serving as acting governor during the incapacity or absence of
    |
0006|     the governor from the state, other than the secretary of
    |
0007|     state, shall receive one hundred fifty dollars ($150) as
    |
0008|     compensation for each day's service as acting governor.
    |
0009|               C.  All compensation under this section shall be
    |
0010|     paid from the general fund, except that the amount paid to the
    |
0011|     commissioner of public lands shall be paid from the state
    |
0012|     [land office] lands maintenance fund."
    |
0013|          Section 2.  Section 10-8-5 NMSA 1978 (being Laws 1978,
    |
0014|     Chapter 184, Section 4, as amended) is amended to read:
    |
0015|          "10-8-5.  RESTRICTIONS--[REGULATIONS] RULES.--
    |
0016|               A.  The secretary may promulgate rules [and
    |
0017|     regulations] for state agencies and local public bodies for
    |
0018|     the purpose of carrying out the provisions of the Per Diem and
    |
0019|     Mileage Act.  Public officials of public post-secondary
    |
0020|     educational institutions and employees of public
    |
0021|     post-secondary educational institutions shall be subject to
    |
0022|     the rules [and regulations] of their governing boards.
    |
0023|               B.  Public funds may be advanced to any public
    |
0024|     officer or employee before the travel occurs only with prior
    |
0025|     written approval of the secretary, the secretary's designee,
    |

0001|     the local public body or the governing board or its designee. 
    |
0002|     This restriction shall not prohibit the use of authorized
    |
0003|     credit cards in connection with purchases necessary to the use
    |
0004|     of vehicles owned by the state, a local public body or a
    |
0005|     public post-secondary educational institution or for food,
    |
0006|     lodging or transportation as permitted by the department of
    |
0007|     finance and administration or the governing board.  Public
    |
0008|     funds shall be paid out [under] pursuant to the Per Diem
    |
0009|     and Mileage Act only upon vouchers duly presented with any
    |
0010|     required receipts attached thereto.  For employees authorized
    |
0011|     to receive public funds in advance of travel, payment shall be
    |
0012|     received only upon vouchers submitted with attached
    |
0013|     authorization for each travel period.  For public officers or
    |
0014|     employees using authorized credit cards, vouchers with
    |
0015|     required receipts for each month's travel expenses shall be
    |
0016|     submitted as a condition to receiving authorization to use the
    |
0017|     credit card for the next month's travel.  Travel expenses may
    |
0018|     also be advanced if the travel is to be performed [under]
    |
0019|     pursuant to provisions of federal or private contracts and
    |
0020|     the funds used are not derived from taxes or revenues paid to
    |
0021|     the state or any of its political subdivisions.
    |
0022|               C.  Money expended by the governor from the
    |
0023|     appropriations made for his office and contingent and other
    |
0024|     expenses are [not] subject to [any of] the foregoing
    |
0025|     provisions of this section and are [not] subject to audit;

0001|     provided that the governor shall only use contingent and other
    |
0002|     expenses for purposes connected with obligations of the
    |
0003|     office.  In addition to the audit, an expenditure report on
    |
0004|     the use of the governor's contingent and other expenses shall
    |
0005|     be submitted annually to the department of finance and
    |
0006|     administration.
    |
0007|               D.  The secretary may reduce the rates set for the
    |
0008|     per diem and mileage for any class of public officials and for
    |
0009|     employees of state agencies, except public officials of public
    |
0010|     post-secondary educational institutions, at any time he deems
    |
0011|     it to be in the public interest, and such reduction shall not
    |
0012|     be construed to permit payment of any other compensation,
    |
0013|     perquisite or allowance.  The secretary shall exercise this
    |
0014|     power of reduction in a reasonable manner and shall attempt to
    |
0015|     achieve a standard rate for all public officers and employees
    |
0016|     of the same classification.  The secretary may, at the request
    |
0017|     of any state agency and for good cause shown, reduce the rates
    |
0018|     of per diem and mileage for that state agency.  The governing
    |
0019|     body of any local public body may eliminate or may reduce the
    |
0020|     rates set for the per diem and mileage for all or any class of
    |
0021|     public officials and employees of the local public body at any
    |
0022|     time the local public body deems it to be in the public
    |
0023|     interest, and such reduction shall not be construed to permit
    |
0024|     payment of any other compensation, perquisite or allowance. 
    |
0025|     The local public body shall exercise this power of reduction
    |

0001|     in a reasonable manner and shall attempt to achieve a standard
    |
0002|     rate for all public officers and employees of the same
    |
0003|     classification.  The secretary may, in extraordinary
    |
0004|     circumstances and with the prior approval of the state board
    |
0005|     of finance in public meeting, allow actual expenses rather
    |
0006|     than the per diem rates set in the Per Diem and Mileage Act.
    |
0007|               E.  The governing board or its designee may reduce
    |
0008|     the rates set for the per diem and mileage for public
    |
0009|     officials of public post-secondary educational institutions
    |
0010|     and for employees of public post-secondary educational
    |
0011|     institutions at any time the governing board deems it to be in
    |
0012|     the public interest, and such reduction shall not be construed
    |
0013|     to permit payment of any other compensation, perquisite or
    |
0014|     allowance.  The governing board shall exercise this power of
    |
0015|     reduction in a reasonable manner and shall attempt to achieve
    |
0016|     a standard rate for public officers and employees of public
    |
0017|     post-secondary educational institutions.  The governing board
    |
0018|     may reduce the rates of per diem and mileage for its public
    |
0019|     post-secondary educational institution and may, in
    |
0020|     extraordinary circumstances and in public meeting, allow
    |
0021|     actual expenses rather than the per diem rates set in the Per
    |
0022|     Diem and Mileage Act.
    |
0023|               F.  No reimbursement for out-of-state travel shall
    |
0024|     be paid to any elected public officer, including any member of
    |
0025|     the legislature, if after the last day to do so that officer
    |

0001|     has not filed a declaration of candidacy for reelection to his
    |
0002|     currently held office or has been defeated for reelection to
    |
0003|     his currently held office in a primary election or any general
    |
0004|     election.
    |
0005|               G.  Subsection F of this section does not apply to
    |
0006|     any elected public officer who is ineligible to succeed
    |
0007|     himself after serving his term in office.
    |
0008|               H.  Subsection F of this section does not apply to
    |
0009|     legislators whose travel has been approved by a three-fourths'
    |
0010|     vote of the New Mexico legislative council at a regularly
    |
0011|     called meeting.
    |
0012|               I.  Any person who is not an employee, appointee or
    |
0013|     elected official of a county or municipality and who is
    |
0014|     reimbursed [under] pursuant to the provisions of the Per
    |
0015|     Diem and Mileage Act in an amount that singly or in the
    |
0016|     aggregate exceeds one thousand five hundred dollars ($1,500)
    |
0017|     in any one year shall not be entitled to further reimbursement
    |
0018|     [under] pursuant to the provisions of that act until the
    |
0019|     person furnishes in writing to his department head or, in the
    |
0020|     case of a department head or board or commission member, to
    |
0021|     the governor or, in the case of a member of the legislature,
    |
0022|     to the New Mexico legislative council an itemized statement on
    |
0023|     each separate instance of travel covered within the
    |
0024|     reimbursement, the place to which traveled and the executive,
    |
0025|     judicial or legislative purpose served by the travel."

0001|          Section 3.  EFFECTIVE DATE.--The effective date of the
    |
0002|     provisions of this act is January 1, 1999.
