LARRANAGA | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| AN ACT | 0011| AMENDING SECTION 61-23-22 NMSA 1978 (BEING LAWS 1993, CHAPTER | 0012| 218, SECTION 17) TO CHANGE ENGINEERING EXEMPTIONS FROM | 0013| REQUIREMENTS OF THE ENGINEERING AND SURVEYING PRACTICE ACT. | 0014| | 0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0016| Section 1. Section 61-23-22 NMSA 1978 (being Laws 1993, | 0017| Chapter 218, Section 17) is amended to read: | 0018| "61-23-22. ENGINEERING--EXEMPTIONS.-- | 0019| A. A New Mexico licensed architect who has | 0020| complied with all of the laws of New Mexico relating to the | 0021| practice of architecture has the right to engage in the | 0022| incidental practice, as defined by regulation, of activities | 0023| properly classified as engineering; provided that the | 0024| architect shall not hold himself out to be an engineer or as | 0025| performing engineering services; and further provided that the |

0001| architect shall perform only that part of the work for which | 0002| he is professionally qualified and shall utilize qualified | 0003| professional engineers or others for those portions of the | 0004| work in which the contracting architect is not qualified. | 0005| Furthermore, the architect shall assume all responsibility for | 0006| compliance with all laws, codes, regulations and ordinances of | 0007| the state or its political subdivisions pertaining to all | 0008| documents bearing his professional seal. | 0009| [B. Officers and employees of the government of | 0010| the United States engaged in the practice of engineering | 0011| insofar that the work involved in said practice is limited and | 0012| restricted to within federal government property shall be | 0013| exempt from the provisions of the Engineering and Surveying | 0014| Practice Act. Any connection or joining of work to other work | 0015| outside of the federal property shall require that the | 0016| connection or joining be specified by engineers registered | 0017| under the provisions of that act. | 0018| C.] B. An engineer employed by a firm, | 0019| association or corporation who performs only the engineering | 0020| services involved in the operation of the employer's business | 0021| shall be exempt from the provisions of the Engineering and | 0022| Surveying Practice Act, provided that neither the employee nor | 0023| the employer offers engineering services to the public." | 0024|  |
