0011|     RELATING TO HEALTH; ELIMINATING THE COORDINATED TREATMENT

0012|     PANEL; CHANGING THE ADMISSION AND TREATMENT CRITERIA AT THE

0013|     ADOLESCENT TREATMENT HOSPITAL.

0015|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0016|          Section 1.  Section 23-9-2 NMSA 1978 (being Laws 1992,
    |
0017|     Chapter 60, Section 2) is amended to read:
    |
0018|          "23-9-2.  DEFINITIONS.--As used in the Adolescent
    |
0019|     Treatment Hospital Act:
    |
0020|               A.  "adolescent" means a person aged thirteen
    |
0021|     through twenty;
    |
0022|               B.  "adolescent treatment hospital" means the
    |
0023|     hospital created pursuant to the Adolescent Treatment Hospital
    |
0024|     Act;
    |
0025|               C.  "board" means the adolescent treatment hospital
    |

0001|     governing board;
    |
0002|               D.  "adolescent residential treatment facility"
    |
0003|     means the facility created pursuant to the Adolescent
    |
0004|     Treatment Hospital Act; <u>and</u>
    |
0005|               <s>[E.  "coordinated treatment panel" means the group
</s>    |
<s></s>0006| <s>    made up of trained health and mental health professionals from
</s>    |
<s></s>0007| <s>    the human services department, the department of health, the
</s>    |
<s></s>0008| <s>    state department of public education and the youth authority
</s>    |
<s></s>0009| <s>    who review and approve psychosocial treatment recommendations,
</s>    |
<s></s>0010| <s>    develop psychosocial treatment alternatives, track costs and
</s>    |
<s></s>0011| <s>    cost-effectiveness and evaluate outcomes; and
</s>    |
<s></s>0012| <s>              F.]</s> <u>E.</u>  "secretary" means the secretary of
    |
0013|     health."

0014|          Section 2.  Section 23-9-6 NMSA 1978 (being Laws 1992,
    |
0015|     Chapter 60, Section 6) is amended to read:
    |
0016|          "23-9-6.  HOSPITAL ADMISSIONS--TREATMENT.--
    |
0017|               A.  Adolescents shall be admitted to the adolescent
    |
0018|     treatment hospital and adolescent residential treatment
    |
0019|     facility only in accordance with the provisions of the Mental
    |
0020|     Health and Developmental Disabilities Code <s>[and pursuant to
</s>    |
<s></s>0021| <s>    the recommendations of the coordinated treatment panel]</s> <u>or
</u>    |
<u></u>0022| <u>    the Children's Mental Health and Developmental Disabilities
</u>    |
<u></u>0023| <u>    Act</u>.
    |
0024|               B.  The secretary shall, in consultation with the
    |
0025|     board, define admittance criteria; provided that the criteria
    |

0001|     may not exclude adolescents in the custody of other agencies
    |
0002|     who might otherwise meet the criteria for services provided
    |
0003|     through the adolescent treatment hospital.
    |
0004|               C.  The Mental Heath and Developmental Disabilities
    |
0005|     Code <u>or the Children's Mental Health and Developmental
</u>    |
<u></u>0006| <u>    Disabilities Act</u> shall apply to inpatient treatment."
