0011|     RELATING TO HEALTH CARE PROVIDERS; PROHIBITING DISCRIMINATION

0012|     AGAINST CERTIFIED NURSE PRACTITIONERS.

0014|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0015|          Section 1.  Section 59A-46-35 NMSA 1978 (being Laws 1987,
    |
0016|     Chapter 335, Section 1, as amended) is amended to read:
    |
0017|          "59A-46-35.  PROVIDER DISCRIMINATION PROHIBITED.--No
    |
0018|     class of licensed individual providers willing to meet the
    |
0019|     terms and conditions offered by a health maintenance
    |
0020|     organization shall be excluded from a health maintenance
    |
0021|     organization.  For purposes of this section, "providers" means
    |
0022|     those persons licensed <s>[under Articles]</s> <u>pursuant to Section
</u>    |
<u></u>0023| <u>    61-3-23.2 NMSA 1978 or Article</u> 2, 4, <s>[5]</s> <u>5A</u>, 6, 8, 9, 10
    |
0024|     or 11 of Chapter 61 NMSA 1978."

0025|          Section 2.  A new section of the New Mexico Insurance

0001|     Code, Section 59A-47-28.3 NMSA 1978, is enacted to read:

0002|          "59A-47-28.3.  [<u>NEW MATERIAL</u>] PROVIDER DISCRIMINATION
    |
0003|     PROHIBITED.--All individual and group subscriber contracts
    |
0004|     delivered or issued for delivery in New Mexico that, on a
    |
0005|     prepaid, service or indemnity basis, or all of them, provide
    |
0006|     for treatment of persons for the prevention, cure or
    |
0007|     correction of an illness or physical or mental condition shall
    |
0008|     include coverage for the services of a certified nurse
    |
0009|     practitioner.  Deductibles, limits of coverage or other terms
    |
0010|     and conditions of coverage for certified nurse practitioners
    |
0011|     shall not differ substantially from coverage for the same or
    |
0012|     similar services provided by other practitioners."
