0012|     INCREASES FOR DISTRICT ATTORNEYS; AUTHORIZING THE LEGISLATURE

0014|     FISCAL YEAR 2000; AMENDING A SECTION OF THE NMSA 1978; MAKING

0017|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0018|          Section 1.  Section 36-1-6 NMSA 1978 (being Laws 1976
    |
0019|     (S.S.), Chapter 18, Section 1, as amended) is amended to read:
    |
0020|          "36-1-6.  DISTRICT ATTORNEYS--SALARIES.--
    |
0021|               A.  <s>[Except as provided in Subsection B of this

<s></s>0022| <s>    section]</s> District attorneys shall receive an annual salary of
    |
0023|     <s>[seventy thousand two hundred sixty-five dollars ($70,265)]</s>
    |
0024|     <u>ninety thousand dollars ($90,000)</u>.

0025|               <s>[B.  District attorneys who serve in a district
</s>    |

<s></s>0001| <s>    that includes a class A county within the district shall
</s>    |
<s></s>0002| <s>    receive an annual salary of seventy-three thousand nine
</s>    |
<s></s>0003| <s>    hundred sixty-three dollars ($73,963).]

<s></s>0004| <s>              <u>B.  For fiscal year 2000 and all subsequent fiscal
</u></s>    |
<u><s></u></s>0005| <u><s>    years, the annual salary for district attorneys shall be
</u></s>    |
<u><s></u></s>0006| <u><s>    established by the legislature in an appropriation act.</u>"

<s></s>0007| <s>         Section 2.  APPROPRIATION.--Three hundred forty-nine
</s>    |
<s></s>0008| <s>    thousand dollars ($349,000) is appropriated from the general
</s>    |
<s></s>0009| <s>    fund to the administrative office of the district attorneys
</s>    |
<s></s>0010| <s>    for expenditure in fiscal year 1999 for the purpose of paying
</s>    |
<s></s>0011| <s>    salaries and benefits for district attorneys.  Any unexpended
</s>    |
<s></s>0012| <s>    or unencumbered balance remaining at the end of fiscal year
</s>    |
<s></s>0013| <s>    1999 shall revert to the general fund.
</s>    |
<s></s>0014| <s>         Section 3.  EFFECTIVE DATE.--The effective date of
</s>    |
<s></s>0015| <s>    provisions of this act is July 1, 1998.
