0011|     RELATING TO MOTOR VEHICLES; AMENDING THE ELEMENTS OF RECKLESS

0012|     DRIVING; PROVIDING PENALTIES; AMENDING A SECTION OF THE MOTOR
    |
0013|     VEHICLE CODE.

0015|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0016|          Section 1.  Section 66-8-113 NMSA 1978 (being Laws 1978,
    |
0017|     Chapter 35, Section 521, as amended) is amended to read:
    |
0018|          "66-8-113.  RECKLESS DRIVING.--
    |
0019|               A.  Any person who drives any vehicle carelessly

    |
0020|     and heedlessly in willful or wanton disregard of the rights or
    |
0021|     safety of others and without due caution and circumspection
    |
0022|     and at a speed or in a manner so as to endanger or be likely
    |
0023|     to endanger any person or property is guilty of reckless
    |
0024|     driving.
    |
0025|               |B.  A person who commits three or more violations
    |

0001|     of the Motor Vehicle Code during a single episode of driving
    |
0002|     is guilty of reckless driving.|
    |
0003|               ~[B.]~ |C.|  Every person convicted of reckless
    |
0004|     driving shall be punished, notwithstanding the provisions of
    |
0005|     Section 31-18-13 NMSA 1978, upon a first conviction by
    |
0006|     imprisonment for not less than five days ~[nor]~ |or| more
    |
0007|     than ninety days or by a fine of not less than twenty-five
    |
0008|     dollars ($25.00) ~[nor]~ |or| more than one hundred dollars
    |
0009|     ($100), or both and on a second or subsequent conviction by
    |
0010|     imprisonment for not less than ten days ~[nor]~ |or| more than
    |
0011|     six months or by a fine of not less than fifty dollars
    |
0012|     ($50.00) ~[nor]~ |or| more than one thousand dollars ($1,000),
    |
0013|     or both.
    |
0014|               ~[C.]~ |D.|  Upon conviction of violation of this
    |
0015|     section, the director may suspend the license or permit to
    |
0016|     drive and any nonresident operating privilege for not to
    |
0017|     exceed ninety days."
    |
0018|          Section 2.  EFFECTIVE DATE.--The effective date of the
    |
0019|     provisions of this act is July 1, 1998.
