0011|     RELATING TO FIRE PROTECTION; PROVIDING FOR A DISTRIBUTION FROM

0012|     THE FIRE PROTECTION FUND TO PROVIDE FOR VEHICLE AND APPARATUS

0013|     PURCHASES; MAKING AN APPROPRIATION.

0015|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0016|          Section 1.  A new section of the Fire Protection Fund Law
    |
0017|     is enacted to read:
    |
0018|          "[|NEW MATERIAL|] VEHICLE AND APPARATUS ACQUISITION FUND-
    |
0019|     -CREATED--DISTRIBUTION--ADVISORY COMMITTEE.--

    |
0020|               A.  The "vehicle and apparatus acquisition fund" is
    |
0021|     created in the state treasury.  Annually, prior to
    |
0022|     distribution of the fire protection fund as provided in
    |
0023|     Section 59A-53-7 NMSA 1978, five percent of the total amount
    |
0024|     in the fire protection fund shall be distributed to the
    |
0025|     vehicle and apparatus acquisition fund.  Money in the fund
    |

0001|     shall be distributed annually by the marshal to the treasurers
    |
0002|     of incorporated municipalities or counties that are recipients
    |
0003|     of grants to acquire firefighting vehicles and related
    |
0004|     apparatus as provided in this section.
    |
0005|               B.  The marshal shall appoint a "vehicle and
    |
0006|     apparatus acquisition advisory committee" to assist him in
    |
0007|     developing a grant application process and approving grants
    |
0008|     for distributions from the fund.
    |
0009|               C.  Each municipality or county applying for a
    |
0010|     grant shall provide a detailed statement and plan for
    |
0011|     providing matching funds and the financial or in-kind match to
    |
0012|     be provided.  A minimum local match of twenty-five percent is
    |
0013|     required.  The municipality or county may satisfy the match
    |
0014|     requirement through a loan from the New Mexico finance
    |
0015|     authority.
    |
0016|               D.  A grant shall not be made for more than
    |
0017|     seventy-five percent of the cost of a vehicle and shall not
    |
0018|     exceed one hundred fifty thousand dollars ($150,000) for each
    |
0019|     municipality or county."
