0011|     DIRECTING THE INTERSTATE STREAM COMMISSION TO COMMENCE
    |
0012|     NEGOTIATIONS TO ACQUIRE EIGHTEEN THOUSAND ACRE-FEET OF WATER
    |
0013|     FOR THE GILA AND SAN FRANCISCO RIVER BASINS AND PROVIDE
    |
0014|     RECOMMENDATIONS TO THE LEGISLATURE.

0016|          WHEREAS, water is a vital resource of New Mexico; and
    |
0017|          WHEREAS, Article 4 of the decree of the supreme court of
    |
0018|     the United States in <u>Arizona</u> v. <u>California</u>, 376 U.S. 340,
    |
0019|     allocated eighteen thousand acre-feet of additional water from
    |
0020|     Gila river sources; and
    |
0021|          WHEREAS, Public Law 90-537, Section 303(f)(1) provides
    |
0022|     for contracting for the eighteen thousand acre-feet of water
    |
0023|     authorized in the <u>Arizona</u> v. <u>California</u> decree; and
    |
0024|          WHEREAS, regional and local water planning for the Gila
    |
0025|     and San Francisco river basins have identified shortfalls of
    |

0001|     water supply for future needs;

0002|          NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
    |
0003|     STATE OF NEW MEXICO that the interstate stream commission
    |
0004|     initiate negotiations to contract with the secretary of the
    |
0005|     interior for the authorized eighteen thousand acre-feet of
    |
0006|     water; and
    |
0007|          BE IT FURTHER RESOLVED that the interstate stream
    |
0008|     commission investigate alternatives for providing payment of
    |
0009|     the New Mexico apportioned capital construction costs of the
    |
0010|     central Arizona project and develop recommendations; and
    |
0011|          BE IT FURTHER RESOLVED that the interstate stream
    |
0012|     commission report the progress of contract negotiations,
    |
0013|     development of payment alternatives and recommendations to the
    |
0014|     water, utilities and natural resources committee or to a
    |
0015|     successor interim committee before the committee's final
    |
0016|     meeting in 1998; and 
    |
0017|          BE IT FURTHER RESOLVED that a copy of this memorial be
    |
0018|     transmitted to the interstate stream commission.
