0011|     REQUESTING THE NEW MEXICO LEGISLATIVE COUNCIL TO ASSIGN A

0012|     REVIEW OF THE STATUS OF THE LOS LUNAS MEDICAL CENTER TO AN
    |
0013|     APPROPRIATE INTERIM COMMITTEE TO IDENTIFY AN APPROPRIATE
    |
0014|     COURSE OF ACTION TO RETURN THE PROPERTY TO FULL USE AND TO
    |
0015|     GENERATE FUNDS FOR THE STATE PERMANENT FUND.

0017|          WHEREAS, the Los Lunas medical center, also known as the
    |
0018|     Los Lunas mental hospital at Los Lunas, is a state institution
    |
0019|     described in Article 14, Section 1 of the constitution of New
    |
0020|     Mexico; and 
    |
0021|          WHEREAS, the state accepted the lands granted by the
    |
0022|     federal government on which the Los Lunas medical center is
    |
0023|     located to be used exclusively for the purpose for which the
    |
0024|     land was granted, as stated in Article 14, Section 2 of the
    |
0025|     constitution of New Mexico; and
    |

0001|          WHEREAS, all lands belonging to the territory of New
    |
0002|     Mexico, and all lands granted, transferred or confirmed to the
    |
0003|     state by congress are declared by the constitution of New
    |
0004|     Mexico to be held or disposed of only for the purposes for
    |
0005|     which they had been granted; and
    |
0006|          WHEREAS, the Los Lunas medical center was vacated by the
    |
0007|     department of health and is no longer in use as a mental
    |
0008|     hospital or medical center; and
    |
0009|          WHEREAS, the Los Lunas school district is interested in
    |
0010|     using the facilities and property of the Los Lunas medical
    |
0011|     center pursuant to a land transfer or lease; and
    |
0012|          WHEREAS, the department of health is considering
    |
0013|     transferring patients from the substance abuse and treatment
    |
0014|     center called Turquoise lodge to be housed at the Los Lunas
    |
0015|     medical center facility; and 
    |
0016|          WHEREAS, the general services department has required
    |
0017|     that a master plan be developed to establish the long-term use
    |
0018|     of the Los Lunas medical center and its surrounding property;
    |
0019|     and
    |
0020|          WHEREAS, it is in the best interest of the state for the
    |
0021|     Los Lunas medical center to be occupied and maintained and for
    |
0022|     the revenue from use or transfer of the Los Lunas medical
    |
0023|     center to be deposited with the commissioner of public lands,
    |
0024|     if that is the appropriate disposition of those revenues; and
    |
0025|          WHEREAS, if the use of the Los Lunas medical center is to
    |

0001|     be changed, the community of Los Lunas would like to be
    |
0002|     permitted input concerning the changes through a public
    |
0003|     hearing process; 
    |
0004|          NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF
    |
0005|     REPRESENTATIVES OF THE STATE OF NEW MEXICO that the New Mexico
    |
0006|     legislative council assign an appropriate interim committee
    |
0007|     the task of reviewing the proposals for utilization of the Los
    |
0008|     Lunas medical center, monitoring the progress of a master plan
    |
0009|     for use of that property and determining if provisions of the
    |
0010|     constitution of New Mexico are being satisfied or if
    |
0011|     constitutional amendments are required to accommodate the uses
    |
0012|     outlined in the master plan; and
    |
0013|          BE IT FURTHER RESOLVED that the village of Los Lunas, the
    |
0014|     Valencia county government and the Los Lunas school district
    |
0015|     be included in any discussions developing the master plan; and
    |
0016|          BE IT FURTHER RESOLVED that copies of this memorial be
    |
0017|     transmitted to the village of Los Lunas, the board of county
    |
0018|     commissioners of Valencia county, the school board of the Los
    |
0019|     Lunas school district, the secretary of health, the secretary
    |
0020|     of general services and the New Mexico legislative council.
