0001| SENATE MEMORIAL 31 | 0002| 43RD LEGISLATURE - STATE OF NEW MEXICO - SECOND SESSION, 1998 | 0003| INTRODUCED BY | 0004| JOHN PINTO | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| A MEMORIAL | 0011| REQUESTING THE STATE HIGHWAY AND TRANSPORTATION DEPARTMENT AND | 0012| THE FEDERAL DEPARTMENT OF TRANSPORTATION TO GIVE PRIORITY TO | 0013| CERTAIN NEEDED ROAD IMPROVEMENTS. | 0014| | 0015| WHEREAS, infrastructure is a vital link in the economic | 0016| development master plan for New Mexico; and | 0017| WHEREAS, the senate is committed to advancing the state's | 0018| economic development prospects by improving the state's | 0019| highway and transportation system; and | 0020| WHEREAS, the state highway and transportation | 0021| department's funds may be available in fiscal year 1999 to | 0022| meet these needs; and | 0023| WHEREAS, annual federal highway funding authorizations | 0024| and reauthorizations result in hundreds of millions of dollars | 0025| available to New Mexico for highway construction and |

0001| improvements; and | 0002| WHEREAS, through various treaties and acts of congress, | 0003| the federal government has promised Indian tribes certain | 0004| goods and services, one of which is transportation services, | 0005| to serve the social and economic needs of Indian tribes; and | 0006| WHEREAS, Indian tribes are totally dependent on the | 0007| federal transportation programs for their transportation needs | 0008| due to federal law denying Indian tribes eligibility to | 0009| administer federal highway trust funds directly or to receive | 0010| a portion of fuel tax revenue collected on Indian reservations | 0011| for transportation purposes; and | 0012| WHEREAS, there is a critical need to improve | 0013| transportation services on the Indian reservations throughout | 0014| the United States to promote economic development, improve | 0015| health care, enhance education and increase employment; and | 0016| WHEREAS, local governments must participate with at least | 0017| ten percent of the costs of the projects enumerated within | 0018| this memorial, and these projects are contingent upon local | 0019| governments obtaining the required rights of way for the | 0020| specified projects enumerated in this memorial and upon all | 0021| projects being under contract by the end of fiscal year 1998; | 0022| and | 0023| WHEREAS, the projects listed below are to be regarded | 0024| with equal priority; and | 0025| WHEREAS, the projects are as follows: |

In McKinley county: | 0002| (1) improvements to the road to the | 0003| university of New Mexico Gallup campus; | 0004| (2) feasibility study for a bypass on the | 0005| north side of Gallup; | 0006| (3) improvements to four miles of United | 0007| States highway 666 between mile markers 65 and 69; | 0008| (4) plan, design and construct the Deer | 0009| Springs road near Mexican Springs; | 0010| (5) plan, design and construct the Coyote | 0011| canyon road; | 0012| (6) plan, design and construct the Rainbow | 0013| Trail road near Panatella; | 0014| (7) plan, design and construct the Red Willow | 0015| road, N7113, near Tohatchi; | 0016| (8) rights of way and clearances for the | 0017| Pipeline road; | 0018| (9) plan, design and construct Johnson and | 0019| Tohlakai roads; | 0020| (10) plan, design and construct Nenahnezad | 0021| and San Juan chapter bus routes; | 0022| (11) plan, design and construct Twin Lakes | 0023| east road, N9659; | 0024| (12) plan, design and construct a road | 0025| between New Mexico highway 264 and Rock Springs; and |

0001| (13) archaeological clearances and | 0002| environmental assessment of the Rio Lobo canyon road to the | 0003| Kerr-McGee uranium mine; and | 0004| B. in San Juan county: | 0005| (1) improvements to the San Juan chapter | 0006| school bus routes; | 0007| (2) feasibility study on widening and | 0008| improving the Upper Fruitland chapter road; | 0009| (3) complete phase 4 street lighting in the | 0010| community of Shiprock; | 0011| (4) improvements to four miles of United | 0012| States highway 666 between mile markers 65 and 69 in the | 0013| Sanostee chapter area; | 0014| (5) improvements to ten miles of the road | 0015| from the table Mesa area and area three in the Sanostee | 0016| chapter area; | 0017| (6) improve the Sanostee chapter road through | 0018| Hidden valley to Wheatfields; | 0019| (7) plan, design and construct the Crystal | 0020| community road; | 0021| (8) rights of way and clearances to county | 0022| road 7750 near Lake Valley; | 0023| (9) plan, design and construct the access | 0024| road and parking area at Crystal; | 0025| (10) rights of way and clearances for N571 |

0001| near Rattlesnake; | 0002| (11) rights of way and clearances for N5012 | 0003| and N5010 from Sanostee to Mitten Rock; | 0004| (12) rights of way and clearances for N69 in | 0005| the Naschitti chapter area; | 0006| (13) plan, design and construct N9652 between | 0007| Naschitti road and White Rock; | 0008| (14) improvements to school bus routes, | 0009| including N5010, in the Sanostee chapter area; | 0010| (15) rights of way and clearances for N5031 | 0011| at Hogback; | 0012| (16) plan, design and construct school bus | 0013| routes in the Nenahnezad and San Juan chapter areas; | 0014| (17) plan, design, and construct N69, the | 0015| Naschitti east loop road; | 0016| (18) plan, design and construct school bus | 0017| routes in the Naschitti area; and | 0018| (19) improvements to school bus routes in the | 0019| Red Valley area; | 0020| NOW, THEREFORE, BE IT RESOLVED BY THE SENATE OF THE STATE | 0021| OF NEW MEXICO that the state highway and transportation | 0022| department be directed to use unexpended funds from the state | 0023| road fund in fiscal year 1999 in the above-described manner | 0024| for the purposes listed herein; and | 0025| BE IF FURTHER RESOLVED that copies of this memorial be |
