0011|     PROPOSING TO AMEND THE CONSTITUTION OF NEW MEXICO TO PROVIDE
    |
0012|     FOR AN OVERRIDE SESSION OF THE LEGISLATURE TO CONSIDER
    |
0013|     LEGISLATION VETOED BY THE GOVERNOR; REQUIRING A THREE-FIFTHS
    |
0014|     MAJORITY TO OVERRIDE LINE-ITEM VETOES.

0016|     BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0017|          Section 1.  It is proposed to amend Article 4, Section 22
    |
0018|     of the constitution of New Mexico to read:
    |
0019|               "A.  Every bill passed by the legislature shall,
    |
0020|     before it becomes a law, be presented to the governor for
    |
0021|     approval. If he approves, he shall sign it, and deposit it
    |
0022|     with the secretary of state; otherwise, he shall return it to
    |
0023|     the house in which it originated, with his objections, which
    |
0024|     shall be entered at large upon the journal; and such bill
    |
0025|     shall not become a law unless thereafter approved by
    |

0001|     two-thirds of the members present and voting in each house by
    |
0002|     yea and nay vote entered upon its journal. Any bill not
    |
0003|     returned by the governor within three days, Sundays excepted,
    |
0004|     after being presented to him, shall become a law, whether
    |
0005|     signed by him or not, unless the legislature by adjournment
    |
0006|     prevent such return. Every bill presented to the governor
    |
0007|     during the last three days of the session shall be approved by
    |
0008|     him within twenty days after the adjournment and shall be by
    |
0009|     him immediately deposited with the secretary of state. Unless
    |
0010|     so approved and signed by him such bill shall not become a
    |
0011|     law. 
    |
0012|               B.  The governor may in like manner approve or
    |
0013|     disapprove any part or parts, item or items, of any bill
    |
0014|     appropriating money, and such parts or items approved shall
    |
0015|     become a law, and such as are disapproved shall be void unless
    |
0016|     passed over his veto [as herein provided] by three-fifths
    |
0017|     of the members present and voting in each house by yea and nay
    |
0018|     vote entered upon its journal."
    |
0019|          Section 2.  It is proposed to amend Article 4 of the
    |
0020|     constitution of New Mexico by adding a new Section 43 to read:
    |
0021|          "Thirty days after a regular, special or extraordinary
    |
0022|     session of the legislature in which any bill presented to the
    |
0023|     governor during the last three days of the session did not
    |
0024|     become a law or if any part or item thereof was disapproved by
    |
0025|     the governor, the legislature shall convene in an override
    |

0001|     session.  Each override session of the legislature shall begin
    |
0002|     at 12:00 noon of the thirtieth day after the adjournment of
    |
0003|     the regular, special or extraordinary session and shall remain
    |
0004|     in session not to exceed five days.  Override sessions shall
    |
0005|     consider only bills and parts or items of bills vetoed by the
    |
0006|     governor during the regular, special or extraordinary
    |
0007|     session."
    |
0008|          Section 3.  The amendment proposed by this resolution
    |
0009|     shall be submitted to the people for their approval or
    |
0010|     rejection at the next general election or at any special
    |
0011|     election prior to that date which may be called for that
    |
0012|     purpose.
