MARQUARDT | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| A JOINT RESOLUTION | 0011| PROPOSING AN AMENDMENT TO ARTICLE 12, SECTION 6 OF THE | 0012| CONSTITUTION OF NEW MEXICO TO ABOLISH THE STATE BOARD OF | 0013| EDUCATION AND CREATE A SECRETARY OF EDUCATION. | 0014| | 0015| BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0016| Section 1. It is proposed to amend Article 12, Section 6 | 0017| of the constitution of New Mexico to read: | 0018| "A. There is hereby created a "state department of | 0019| public education" [and a "state board of education". The | 0020| state board of education] within the executive department | 0021| headed by a secretary appointed by the governor with the | 0022| consent of the senate. The state department of public | 0023| education shall determine public school policy and vocational | 0024| educational policy and shall have control, management and | 0025| direction, including financial direction, distribution of |

0001| school funds and financial accounting for all public schools, | 0002| pursuant to authority and powers provided by law. [The board | 0003| shall appoint a qualified, experienced educational | 0004| administrator to be known as the superintendent of public | 0005| instruction, who shall, subject to the policies established by | 0006| the board] The secretary shall direct the operation of the | 0007| state department of public education. | 0008| [B. Ten members of the state board of education | 0009| who shall be state officers shall be elected for staggered | 0010| terms of four years as provided by law. Board members shall | 0011| be residents of the board of education district from which | 0012| they are elected. Change of residence of a board member to a | 0013| place outside the district from which he was elected shall | 0014| automatically terminate the term of that member. | 0015| C. Five members of the state board of education | 0016| who shall be state officers shall be nominated and by and with | 0017| the consent of the senate appointed by the governor from five | 0018| districts substantially equal in population for staggered | 0019| four-year terms as provided by law. Those appointed by the | 0020| governor shall be qualified electors of the state of New | 0021| Mexico, no more than one-half or a simple majority of whom at | 0022| the time of their appointment shall be members of the same | 0023| political party. After 1990, the number of appointed members | 0024| may be changed by law not to exceed five members. | 0025| D. The governor shall fill vacancies on the board |

0001| by appointment of a resident from the district in which the | 0002| vacancy occurs until the next regular election for membership | 0003| on the board. | 0004| E.] B. Upon adoption of this amendment, all | 0005| functions relating to the distribution of school funds and | 0006| financial accounting for the public schools shall be | 0007| transferred to the state department of public education to be | 0008| performed as provided by law." | 0009| Section 2. The amendment proposed by this resolution | 0010| shall be submitted to the people for their approval or | 0011| rejection at the next general election or at any special | 0012| election prior to that date which may be called for that | 0013| purpose. | 0014| + |
