AN ACT

RELATING TO DISSOLUTION OF MARRIAGE; PROVIDING FOR COUNSELING IN PROCEEDINGS FOR DISSOLUTION OF MARRIAGE.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. COUNSELING.--

A. The court shall require that the parties undergo counseling during the proceedings for the dissolution of marriage if a judgment or decree will be entered awarding the custody of a minor. The parties shall pay for the costs of counseling, which may be allocated between the parties by the court.

B. The court may exempt parties from the counseling requirement of this section if it finds and includes in its decree that counseling would be unjust or inappropriate.
