AN ACT

RELATING TO DOMESTIC RELATIONS; LIMITING CHILD VISITATION RIGHTS OF A PARENT CONVICTED OF FIRST DEGREE MURDER OF THE OTHER PARENT OF THE CHILD.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. CHILD VISITATION LIMITATIONS.--A court shall not issue an order providing child visitation rights to a parent who has been convicted of murder in the first degree of the other parent of the child who would be the subject of the order, unless the child is of suitable age to signify his assent and assents to the order. Until an order providing child visitation rights has been issued, a person shall not take a child to visit a parent who has been convicted of murder in the first degree of the other parent of the child without the consent of the child's custodian or legal guardian.

Section 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 1999.
