SENATE FLOOR AMENDMENT number _______ to SENATE BILL 588, as amended

Amendment sponsored by Senator Patrick H. Lyons

1. On page 11, line 12, after "if" insert a colon and strike the remainder of the line and strike all of lines 13 through 16 and insert in lieu thereof the following paragraphs:

"(1) the sale occurs on the Indian reservation or pueblo grant of the distributor's Indian nation, tribe or pueblo;

(2) the gasoline is placed into the fuel supply tank of a motor vehicle on that reservation or pueblo grant; and

(3) the sale is made to the distributor's Indian nation, tribe or pueblo or any agency, instrumentality or member of that nation, tribe or pueblo; and provided that the Indian nation, tribe or pueblo and the department may agree upon a convention or formula to approximate the gallons of gasoline sold to the Indian nation, tribe or pueblo or to its agencies, instrumentalities or members; and".
