PROPOSING AN AMENDMENT TO ARTICLE 10, SECTION 1 OF THE CONSTITUTION OF NEW MEXICO TO ALLOW FOR MIDTERM SALARY INCREASES FOR COUNTY OFFICERS.
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. It is proposed to amend Article 10, Section 1 of the constitution of New Mexico to read:
"The legislature shall at its first session classify the counties and fix salaries for all county officers, which shall also apply to those elected at the first election under this constitution. And no county officer shall receive to his own use any fees or emoluments other than the annual salary provided by law, and all fees earned by any officer shall be by him collected and paid into the treasury of the county.
Notwithstanding Article 4, Section 27 of the constitution of New Mexico, a board of county commissioners may provide a midterm salary increase for any elected county officer as authorized by the legislature."
Section 2. The amendment proposed by this resolution shall be submitted to the people for their approval or rejection at the next general election or at any special election prior to that date which may be called for that purpose.
