AN ACT

RELATING TO STATE REVENUES; PROVIDING FOR A TRANSFER FROM THE GENERAL FUND AMOUNTS RECEIVED BY THE STATE PURSUANT TO CERTAIN REVENUE-SHARING AGREEMENTS WITH INDIAN NATIONS, TRIBES OR PUEBLOS; MAKING AN APPROPRIATION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. APPROPRIATION.--Upon the receipt of a payment from an Indian nation, tribe or pueblo pursuant to a revenue-sharing agreement entered into prior to January 1, 2000 pursuant to Section 11-13-2 NMSA 1978 that provides for the state to receive a share of the net win from Indian gaming revenue, an amount equal to the payment received by the state for back payments due but not paid before February 1, 2000 is appropriated from the general fund, as it is paid to the state, to the state department of public education for expenditure in fiscal years 2001-2004 for educational initiatives recommended by the education initiatives and accountability task force. Any unexpended or unencumbered balance remaining at the end of fiscal year 2004 shall revert to the general fund.
