SUMMARY

Synopsis of Bill

House Bill 286 requires deposits for certain recounts or rechecks to be deposited with the Secretary of State.

Significant Issues

The bill stipulates that if a recount or recheck is in regards to an office for which the state canvassing board is responsible, then the funds for the recount are to be deposited to the Secretary of State.

Currently, funds for recount or recheck are deposited to the proper canvassing board and go into the general fund. When this occurs, the Secretary of State is unable to draw on these funds for such expenses as sheriff summons or precinct board expenses. These items are currently paid out of the operating budget of the Secretary of State.

FISCAL IMPLICATIONS

The bill will allow the Secretary of State to utilize the funds that are currently going into the general fund. This may require specific budget increase authority in the General Appropriations Act.
