SUMMARY
Synopsis of Bill
Senate Bill 409 amends the New Mexico Insurance Code. The bill clarifies that rule making is subject to the State Rules Act and the public hearing process and adopts life safety codes which shall be compatible with the Uniform Building Code (UBC). Additionally, the bill states that certain rules only apply during the use and occupancy of buildings.
Significant Issues
This bill limits the ability of the State Fire Marshal to impose standards different than those that match the UBC. The State Fire Marshal may not impose additional standards subsequent to the issuance of a certificate of occupancy (CO) by a building official.
FISCAL IMPLICATIONS
Senate Bill 409 does not contain an appropriation and would not have a fiscal or administrative impact on the Public Regulation Commission or the Regulation and Licensing Department (RLD).
