Your JUDICIARY COMMITTEE, to whom has been referred



HOUSE BILL 273



has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:



1. On page 1, strike lines 19 through 25 and on page 2, strike lines 1 through 19 and insert in lieu thereof:



"(1) for the replacement of federal and other funds, one million one hundred six thousand five hundred dollars ($1,106,500) to be distributed as follows:

(a) one hundred forty-nine thousand dollars ($149,000) to the administrative office of the courts to replace expiring federal funds for supplies and equipment and to provide salary and benefits and contractual services;



(b) one hundred eight thousand dollars ($108,000) to the second judicial district to replace expiring federal and other funds for the juvenile drug court to provide salary and benefits for drug court personnel;



(c) two hundred fifty-six thousand eight hundred dollars ($256,800) to the sixth judicial district to replace expiring federal funds for the juvenile drug court for contractual services, supplies and equipment and to provide salaries and benefits;



(d) two hundred seventy-five thousand dollars ($275,000) to the eighth judicial district to replace expiring federal funds for the juvenile drug court for supplies and equipment and contractual services;



(e) sixty-six thousand seven hundred dollars ($66,700) to the eleventh judicial district to replace expiring other funds for the adult drug court to provide salary and benefits for drug court personnel; and



(f) two hundred fifty-one thousand dollars ($251,000) to the thirteenth judicial district to replace expiring federal funds for the juvenile drug court for supplies and equipment, contractual services and salary and benefits for drug court personnel;



(2) for new juvenile and family dependency drug courts, one million four hundred ninety-two thousand nine hundred dollars ($1,492,900) to be distributed as follows:



(a) one hundred one thousand dollars ($101,000) to the second judicial district for the operation, contractual services and supplies and equipment to start a family dependency drug court;



(b) one hundred nineteen thousand nine hundred dollars ($119,900) to the third judicial district for the operation, supplies and equipment, contractual services and salary and benefits for drug court personnel to start a family dependency drug court;



(c) two hundred two thousand three hundred dollars ($202,300) to the fourth judicial district for the operation, supplies and equipment, contractual services and salary and benefits for drug court personnel to start a juvenile drug court;



(d) two hundred nine thousand eight hundred dollars ($209,800) to the fifth judicial district for the operation, supplies and equipment, contractual services and salary and benefits for drug court personnel to start a juvenile drug court;



(e) one hundred seventy-one thousand four hundred dollars ($171,400) to the fifth judicial district for the operation, supplies and equipment, contractual services and salary and benefits for drug court personnel to start a family dependency drug court;



(f) three hundred sixty-four thousand dollars ($364,000) to the eleventh judicial district for the operation, supplies and equipment, contractual services and salary and benefits for drug court personnel to start a juvenile drug court in McKinley county; and



(g) three hundred twenty-four thousand five hundred dollars ($324,500) to the thirteenth judicial district for the operation, supplies and equipment, contractual services and salary and benefits for drug court personnel to start juvenile drug courts in Cibola and Valencia counties; and



(3) for the expansion and enhancement of existing drug courts in the amount of three million nine hundred twenty- five thousand eight hundred dollars ($3,925,800) to be distributed as follows:



(a) one hundred two thousand five hundred dollars ($102,500) to the first judicial district for salaries and benefits to expand adult and juvenile drug courts;



(b) four hundred seventy-six thousand six hundred dollars ($476,600) to the second judicial district for supplies and equipment, contractual services and salary and benefits to expand the adult drug court;



(c) forty-three thousand dollars ($43,000) to the third judicial district for salary and benefits to expand the adult drug court;



(d) one hundred three thousand nine hundred dollars ($103,900) to the eighth judicial district for salaries and benefits to expand the juvenile drug court;



(e) one hundred eighteen thousand seven hundred dollars ($118,700) to the eleventh judicial district for salaries and benefits to expand the adult drug court;



(f) five hundred eighty-three thousand three hundred dollars ($583,300) to the thirteenth judicial district for supplies and equipment, contractual services and salary and benefits to expand the juvenile drug court;



(g) two million two hundred forty-two thousand seven hundred dollars ($2,242,700) to the Bernalillo metropolitan court for supplies and equipment, contractual services and salaries and benefits to expand the DWI drug court;



(h) eighty-four thousand two hundred dollars ($84,200) to the McKinley county magistrate court for contractual services and salaries and benefits to expand the DWI drug court; and



(i) one hundred seventy thousand nine hundred dollars ($170,900) to the administrative office of the courts for supplies and equipment, contractual services and salaries and benefits to expand statewide drug court administration.



B. Except as prohibited by federal law, if a new program that is funded in Subsection A of this section receives federal funds for the same purpose, the federal funds shall be used.".
