AN ACT

MAKING AN APPROPRIATION TO EXPAND DRUG COURT PROGRAMS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. APPROPRIATION.--

A. The following amounts are appropriated from the general fund to the following agencies for expenditure in fiscal year 2003 for adult and juvenile drug courts as follows:

(1) to the administrative office of the courts:

(a) one million four hundred twenty-five thousand seven hundred dollars ($1,425,700) to replace federal and other funds for existing drug courts;

(b) one million one hundred thirty-two thousand five hundred dollars ($1,132,500) to institute new juvenile drug courts in selected district courts; and

(c) three million eight hundred eighteen thousand two hundred dollars ($3,818,200) to enhance and expand existing drug courts;

(2) to the public defender department:

(a) thirty-three thousand dollars ($33,000) to replace federal funds for the juvenile drug court in the eighth judicial district;

(b) one hundred eighty-nine thousand dollars ($189,000) for costs associated with new juvenile drug courts in selected district courts; and

(c) sixty-three thousand three hundred dollars ($63,300) for costs associated with the expansion of the second judicial district adult drug court and for a social worker and public defender for the McKinley county magistrate driving while intoxicated program; and

(3) to the second judicial district attorney, forty-four thousand three hundred dollars ($44,300) for a screener to make referrals to the adult drug court.

B. Any unexpended or unencumbered balance remaining at the end of fiscal year 2003 shall revert to the general fund.
