AN ACT

RELATING TO EMPLOYERS; PROVIDING A WAIVER OF WORKERS' COMPENSATION FEES AND UNEMPLOYMENT CONTRIBUTIONS OF EMPLOYERS UNDER CERTAIN CIRCUMSTANCES; REQUIRING PAYMENT OF CERTAIN EMPLOYEES' WAGES BY THE MEDICAID PROGRAM.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. WAIVER OF WORKERS' COMPENSATION FEE--WAIVER OF EMPLOYERS' CONTRIBUTION TO UNEMPLOYMENT COMPENSATION FUND--PAYMENT OF CERTAIN WAGES BY MEDICAID PROGRAM.--

A. If an employer hires an individual who is receiving financial assistance pursuant to the New Mexico Works Act and the financial assistance is terminated because of that employment, the employer's:

(1) quarterly payment of the workers' compensation administrative fee imposed pursuant to Section 52-5-19 NMSA 1978 is waived for the quarter in which the worker is first employed; and

(2) contributions to the unemployment compensation fund on behalf of the employed individual pursuant to Section 51-1-11 NMSA 1978 are waived for a period of six months from the date the individual is employed.

B. The wages of an individual employed as described in Subsection A of this section shall be paid by the medicaid program.
