AN ACT

MAKING AN APPROPRIATION TO THE STATE DEPARTMENT OF PUBLIC EDUCATION FOR AN EMERGENCY SUPPLEMENTAL DISTRIBUTION FOR DISTRICTS WITH AN INCREASE IN MEM GREATER THAN ONE PERCENT; DECLARING AN EMERGENCY.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. APPROPRIATION.--Two million dollars ($2,000,000) is appropriated from the general fund to the state department of public education for expenditure in fiscal years 2003 and 2004 for an emergency supplemental distribution to provide additional public school support for districts with an increase in MEM equal to or greater than one percent when compared with the immediately preceding year. The distribution is contingent upon verification of growth by the superintendent of public instruction.

Section 2. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
