Your JUDICIARY COMMITTEE, to whom has been referred



SENATE BILL 23, as amended



has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:



1. On page 1, line 13, strike "AMENDING AND REPEALING" and insert in lieu thereof "REPEALING AND ENACTING".



2. On page 1, lines 17 and 18, strike "Sections 1 through 13 of this" and insert in lieu thereof "This".



3. On pages 1 and 2, strike Section 2 in its entirety.



4. Renumber the succeeding sections accordingly.



5. On page 6, line 19, strike "sixty-day" and insert in lieu thereof "thirty-day".



6. On page 6, strike lines 24 and 25 in their entirety and on page 7, strike line 1 in its entirety and insert in lieu thereof:



"A. Pursuant to rules adopted by the department, the department, within thirty days after receiving a completed application for a concealed handgun license and the results of a national criminal background check on the applicant, shall:".



7. On page 10, line 19, before "Nothing" insert the subsection designation "A.".



8. On page 10, between line 23 and 24, insert the following new subsections to read:



"B. Nothing in the Concealed Handgun Carry Act shall be construed as allowing a licensee in possession of a valid concealed handgun license to carry a concealed handgun on school premises, as provided in Section 30-7-2.1 NMSA 1978.



C. Nothing in the Concealed Handgun Carry Act shall be construed as allowing a licensee in possession of a valid concealed handgun license to carry a concealed handgun on the premises of a preschool.".



9. On page 11, between lines 5 and 6, insert the following new section to read:



"Section 11. [NEW MATERIAL] VALIDITY OF LICENSE IN A COURTHOUSE OR COURT FACILITY.--A concealed handgun license shall not be valid in a courthouse or court facility, unless authorized by the presiding judicial officer for that courthouse or court facility.".



10. Renumber the succeeding sections accordingly.



11. On page 11, line 19, strike "and".



12. On page 11, line 22, strike the period and insert in lieu thereof "; and".



13. On page 11, between lines 22 and 23, insert the following new subsection to read:



"E. provision of authority for the transfer of a concealed handgun license issued by another state.".



14. On pages 12 and 13, strike Section 14 in its entirety.



15. Renumber the succeeding sections accordingly.,



and thence referred to the APPROPRIATIONS AND FINANCE COMMITTEE.
