AN ACT

RELATING TO GAME AND FISH; MAKING IT UNLAWFUL TO SHOOT AT ARTIFICIAL GAME ANIMALS OR BIRDS; PROVIDING PENALTIES; ENACTING A NEW SECTION OF CHAPTER 17 NMSA 1978.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. A new section of Chapter 17 NMSA 1978 is enacted to read:

"[NEW MATERIAL] ARTIFICIAL GAME.--

A. It is unlawful for a person to shoot, attempt to shoot, take or attempt to take artificial or simulated game animals or birds being used by conservation officers to detect and apprehend a person who is violating game and fish laws or rules.

B. A person who is convicted of violating Subsection A of this section shall be sentenced pursuant to Section 17-2-10 NMSA 1978 for the species that the artificial game animal or bird simulates."

Section 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2003.
