Your CORPORATIONS AND TRANSPORTATION COMMITTEE, to whom has been referred

has had it under consideration and reports same with recommendation that it DO NOT PASS, amended as follows:

1. On page 1, line 15, strike "Section 59A-2-9.4" and insert in lieu thereof "section of Chapter 59A, Article 16".

2. On page 1, line 17, strike "59A-2-9.4" and "MANDATORY".

3. On page 2, between lines 4 and 5, insert the following new subsection:

"B. An insurer shall not refuse to honor an assignment of a claim under a health care plan. An insurance policy or contract issued or renewed after June 30, 2003 shall not contain a restriction on the insured's right to assign a claim to a provider of health care services.".

4. Renumber the succeeding subsections accordingly.

5. On page 2, between lines 11 and 12, insert the following new section:

"Section 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2004.".
