AN ACT

RELATING TO STATE PARKS; REQUIRING THE LEGISLATURE TO SET FEES FOR STATE PARKS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. A new section of Chapter 16, Article 2 NMSA 1978 is enacted to read:

"[NEW MATERIAL] STATE PARK FEES--LEGISLATIVE RESPONSIBILITY.--

A. The legislature shall set fees for the state parks and shall not delegate that duty to an executive agency. The state parks division of the energy, minerals and natural resources department may suggest to the legislature a new fee schedule or changes to an existing fee schedule in order to fulfill its duty to make the state parks as nearly self-supporting as possible; however, a fee change shall not be implemented unless the change is approved by the legislature and set forth in statute.

B. The fee schedule for state parks in place on April 1, 2002 shall remain in effect until a fee schedule is adopted by the legislature."

Section 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2003.
