Your JUDICIARY COMMITTEE, to whom has been referred



SENATE BILL 194, as amended



has had it under consideration and reports same WITHOUT RECOMMENDATION, amended as follows:



1. Strike all senate public affairs committee amendments.



2. On page 10, line 8, strike "ten" and insert in lieu thereof "five".



3. On page 14, line 20, strike "Section 8" and insert in lieu thereof "Sections 7, 8 and 10".



4. On page 19, line 22, after the comma insert "to the extent established in the Tort Claims Act,".



5. On page 20, line 14, after "calculated" strike the remainder of the line, strike line 15 in its entirety and insert in lieu thereof "shall include lost revenues and expenses incurred due to the taking or appropriation of property, including a health facility.".



6. On page 20, strike lines 16 through 20 in their entirety.



7. Reletter the succeeding subsections accordingly.



















8. On page 20, line 21, after the second occurrence of "the" insert "preliminary".



9. On page 20, line 25, after the period insert:

"A determination made by the attorney general pursuant to this

section shall be subject to appeal pursuant to the provisions of Section 39-3-1.1 NMSA 1978.".



10. On page 21, line 3, strike "destruction" and insert in lieu thereof "taking or appropriation".



11. On page 21, line 4, strike "destroyed" and insert in lieu thereof "taken or appropriated".



12. On page 21, line 5, strike "existing" and insert in lieu thereof "the Eminent Domain Code, other applicable".



13. On page 21, between lines 6 and 7, insert the following new section read:

"Section 16. A new section of Chapter 12, Article 10 NMSA 1978 is enacted to read:



"[NEW MATERIAL] JOB PROTECTION FOR A PERSON WHO IS ISOLATED OR QUARANTINED.--An employer or an agent of an employer shall not discharge from employment a person who is placed in isolation or quarantine pursuant to the provisions of the Public Health Emergency Response Act."".



14. Renumber the succeeding sections accordingly.
