AN ACT

RELATING TO ECONOMIC DEVELOPMENT; CREATING THE FILM INDUSTRY PROMOTION COMMISSION; MAKING AN APPROPRIATION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. A new section of the Economic Development Department Act is enacted to read:

"[NEW MATERIAL] FILM INDUSTRY PROMOTION COMMISSION.--

A. The "film industry promotion commission" is created and is administratively attached to the economic development department. The commission shall advise the department and the governor on ways to promote film production in New Mexico and shall make recommendations for incentives and funding for this purpose.

B. The commission shall be composed of five members appointed by the governor. At least three members shall have experience in some aspect of the film production industry. The initial members shall be appointed to staggered terms, with three members appointed for four-year terms and two members for two-year terms. Terms shall expire on May 1 of the appropriate year. The commission shall elect a chair from among its membership and shall meet at least quarterly at the call of the chair. A majority of the members appointed constitutes a quorum for the conduct of business.

C. The commission shall report to the governor and the legislature by December 1 of each year on their activities and recommendations for promoting film production in New Mexico.

D. Commission members shall not be paid, but shall receive per diem and mileage as provided in the Per Diem and Mileage Act."

Section 2. APPROPRIATION.--One hundred thousand dollars ($100,000) is appropriated from the general fund to the economic development department for expenditure in fiscal year 2004 to carry out the provisions of this act. Any unexpended or unencumbered balance remaining at the end of fiscal year 2004 shall revert to the general fund.
