AN ACT

RELATING TO HEALTH RECORDS; PROHIBITING THE IDENTIFICATION OF A MEDICAL CONDITION IN A MANNER THAT IMPLIES A CRIME WAS COMMITTED; ENACTING A SECTION OF THE NMSA 1978.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. A new Section 14-6-4 NMSA 1978 is enacted to read:

"14-6-4. [NEW MATERIAL] REFERENCES TO MEDICAL CONDITIONS IMPLYING CRIMINAL ACTIVITY PROHIBITED.--A health care provider shall not identify a medical condition, diagnosis or syndrome in a manner that implicitly or explicitly states that a crime was committed. A health care provider shall identify a medical condition, diagnosis or syndrome with an appropriate medically specific description. The identification of a medical condition, diagnosis or syndrome pursuant to this section applies to verbal, written or electronic communications."
