SUMMARY

     Synopsis of Bill

 

Senate Bill 311 appropriates $310.0 from the general fund to the local government division of

the department of finance and administration for expenditure in fiscal years 2003 and 2004 to defray the county's cost of transporting prisoners from Tierra Amarilla to Santa Fe by the Rio Arriba County Sheriff's department.  Unexpended balance at the end of fiscal year 2004 shall revert to the general fund.  This legislation includes an emergency clause.

     Significant Issues

 

According to the Department of Finance and Administration, this legislation assigns additional responsibilities to LGD-DFA without providing the necessary funds to adequately carry them out.

  

FISCAL IMPLICATIONS

 

The appropriation of $310.0 is a recurring expense, since the counties will inevitably continue to encumber these costs year after year.

 

POSSIBLE QUESTIONS

 

  1. Why are these costs not automatically included in the county budget?

 

  1. Upon approval of this appropriation, will other counties expect the same appropriation to their respective counties for the same purpose?  Will this cause a continued strain to the state general fund budget?

 

  1. What is the cost break down for the transportation of each prisoner?  How many prisoners have been transported in the last fiscal year?
