HOUSE FLOOR AMENDMENT number ___1__ to HOUSE JUDICIARY COMMITTEE SUBSTITUTE FOR HOUSE BILL 9, as amended

Amendment sponsored by Representative Youngberg

    1. On page 6, line 3, after the semicolon insert "and".

    2. On page 6, line 5, strike "; and" and insert in lieu thereof a period.

    3. On page 6, lines 6 through 8, strike Paragraph (7) in its entirety.

    4. On page 6, line 16, strike "or".

    5. On page 6, line 18, strike the period and insert in lieu thereof "; or".

    6. On page 6, between lines 18 and 19, insert the following new paragraph:

             "(3) the increase in local prices is attributable to national or international trends or regional, national or international indices or postings.".

    7. On page 7, strike all of lines 9 through 14 and insert in lieu thereof:

    "Section 8. APPLICATION OF UNFAIR PRACTICES ACT--ATTORNEY FEES.--

         A. A violation of the Emergency Anti-Price-Gouging Act constitutes an unfair or deceptive trade practice and an unconscionable trade practice pursuant to the Unfair Practices Act and is subject to all of the provisions and remedies of that act.

         B. Notwithstanding the provisions of Subsection A of this section, no private action may be brought pursuant to the Emergency Anti-Price-Gouging Act.".
