AN ACT

MAKING AN APPROPRIATION TO THE FIRE PROTECTION FUND FOR THE PURPOSE OF IMPROVING FIRE DEPARTMENTS WITH POOR RATINGS FROM THE INSURANCE SERVICES OFFICE.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. APPROPRIATION--FIRE DEPARTMENT IMPROVEMENTS.--Ten million dollars ($10,000,000) is appropriated from the general fund to the fire protection fund for expenditure by the state fire marshal in fiscal years 2006 through 2008 for the purpose of improving fire departments with a rating from the insurance services office of class 6 or greater. Upon application by a fire department and pursuant to rules promulgated by the state fire marshal, the state fire marshal shall make the distributions only for specific improvements designed to enhance the rating. Any unexpended or unencumbered balance remaining at the end of fiscal year 2008 shall revert to the general fund.
