FORTY-SEVENTH LEGISLATURE

Mr. Speaker:

    Your VOTERS AND ELECTIONS COMMITTEE, to whom has been referred

SENATE BILL 295, as amended

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

     1. Strike Items 2 through 4 of Senate Floor Amendment 1.

     2. Strike Senate Public Affairs Committee Amendment 6.

     3. On page 1, strike line 13 in its entirety and on line 14, strike "CODE;".

     4. On page 3, line 6, strike "March" and insert in lieu thereof "May".

     5. On page 3, line 8, after "until" strike the remainder of the line, strike lines 9 through 13 in their entirety and insert in lieu thereof:

"an adequate supply of voting systems is available and sufficient federal, state or local funds are available:

                (1) to replace the voting systems;

                (2) to acquire the necessary software;

                (3) for the secretary of state to purchase the paper ballots for all counties to use on the new voting system for primary and general elections; and

                (4) to hold the counties harmless for payments due for voting systems under lease-purchase agreements entered into pursuant to Sections 1-9-17 through 1-9-19 NMSA 1978.".

     6. On page 3, line 15, strike "that" and insert in lieu thereof "if it" and after "state" insert the following:

"and if a competitive bid process has not been conducted by the secretary of state pursuant to the provisions of Chapter 13, Article 1 NMSA 1978".

     7. On page 4, strike Section 3 in its entirety.

     8. Renumber the succeeding section accordingly.
