FORTY-SEVENTH LEGISLATURE

    Your BUSINESS AND INDUSTRY COMMITTEE, to whom has been referred

SENATE BILL 344, as amended

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

     1. Strike Senate Rules Committee Amendment 4.

     2. Strike Senate Floor Amendments 1 and 2.

     3. On page 2, line 1, after "given" insert "by the prospective contractor or a family member or representative of the prospective contractor".

     4. On page 2, line 7, after "contributions" insert "given by the prospective contractor or a family member or representative of the prospective contractor".

     5. On page 2, line 20, after "official" insert ", whose family members have not contributed to an applicable public official or whose representatives have not contributed to an applicable public official".

     6. On page 2, line 23, after "contractor" insert "or a family member or representative of the prospective contractor".

     7. On page 3, line 5, after "if" strike the remainder of the line and insert in lieu thereof a colon, strike lines 6 through 8 in their entirety and insert the following:

                "(1) a prospective contractor fails to submit a fully completed disclosure statement pursuant to this section; or

                (2) a prospective contractor or family member or representative of the prospective contractor gives a campaign contribution or other".

     8. On page 3, line 20, after the semicolon strike "and" and between lines 20 and 21 insert the following new paragraphs:

                "(2) "family member" means spouse, father, mother, child, father-in-law, mother-in-law, daughter-in-law or son-in-law;

                 (3) "pendency of the procurement process" means the time period commencing with the public notice of the request for proposals and ending with the award of the contract or the cancellation of the request for proposals;".

     9. Renumber the succeeding paragraph accordingly.

     10. On page 3, line 25, strike the period and insert in lieu thereof "; and" and before the quotation mark insert the following new paragraph:

                "(5) "representative of the prospective contractor" means an officer or director of a corporation, a member or manager of a limited liability corporation, a partner of a partnership or a trustee of a trust of the prospective contractor.".
