A JOINT MEMORIAL

REQUESTING THE NEW MEXICO HEALTH POLICY COMMISSION TO CONTINUE RESEARCH AND ANALYSIS OF PHARMACY BENEFIT MANAGER ACTIVITIES AND LAWS THAT REGULATE PHARMACY BENEFIT MANAGERS.

 

     WHEREAS, House Joint Memorial 98, which passed in 2005, called for a study of the need for regulation and oversight of pharmacy benefit manager companies; and

     WHEREAS, a report of the findings and recommendations of that study was presented to the interim legislative health and human services committee in October 2005; and

     WHEREAS, the findings acknowledged that there was disagreement on whether pharmacy benefit manager companies need to be regulated, and it was difficult to determine which existing laws may already adequately regulate pharmacy benefit manager companies; and

     WHEREAS, local data are not available to determine the number of pharmacy benefit manager companies that operate in New Mexico or the number of people that are being served by pharmacy benefit manager companies; and

     WHEREAS, with the implementation of the medicare part D pharmacy benefit, many pharmacy benefit manager companies may now be assuming new roles and responsibilities relative to this new program; and

     WHEREAS, there was agreement that more research and analysis of pharmacy benefit manager activities and existing federal and state laws that regulate them would be valuable;

     NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO that the New Mexico health policy commission be requested to continue research and analysis of pharmacy benefit manager activities and laws that regulate pharmacy benefit managers; and

     BE IT FURTHER RESOLVED that a report of the findings and recommendations be presented to the legislative health and human services committee at its October 2006 meeting; and

     BE IT FURTHER RESOLVED that a copy of this memorial be sent to the director of the New Mexico health policy commission.
