AN ACT

RELATING TO ALCOHOLIC BEVERAGES; PROHIBITING THE OFF-PREMISES SALE OF REFRIGERATED ALCOHOLIC BEVERAGES; CREATING A PENALTY; DECLARING AN EMERGENCY.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. A new section of the Liquor Control Act is enacted to read:

     "[NEW MATERIAL] REFRIGERATED SALES OF ALCOHOLIC BEVERAGES PROHIBITED--PENALTY.--

          A. It is a violation of the Liquor Control Act for a person holding a license issued pursuant to the Liquor Control Act to sell for consumption off the licensed premises alcoholic beverages that have been refrigerated or otherwise cooled or chilled in any manner.

          B. A person knowingly violating Subsection A of this section is guilty of a fourth degree felony and shall be sentenced in accordance with the provisions of Section 31-18-15 NMSA 1978."

     Section 2. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
