AN ACT

RELATING TO CONSTRUCTION STANDARDS; PROVIDING STANDARDS FOR NITROUS OXIDE GAS SYSTEMS IN THE CONSTRUCTION OF DENTAL FACILITIES; DECLARING AN EMERGENCY.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. CONSTRUCTION STANDARDS--DENTAL FACILITIES.--A dental office or other facility in which nitrous oxide will be administered without a halogenated agent shall comply with the national fire protection association's Standard for Health Care Facilities' level three piped gas and vacuum systems standard for waste anesthetic gas disposal systems, or its equivalent. A municipality, including a home rule municipality, shall not require a more restrictive construction standard than is required by this section.

     Section 2. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
