Mr. Speaker:

 

    Your HEALTH AND GOVERNMENT AFFAIRS COMMITTEE, to whom has been referred

 

SENATE BILL 659

 

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

 

     1.   On page 3, line 5, through page 4, line 11, strike Section 2 in its entirety.

 

     2. Renumber the succeeding sections accordingly.

 

     3. On page 5, lines 9 and 10, strike "that lies within the boundaries of the municipality".

 

     4. On page 5, line 13, strike "property" and insert in lieu thereof "wells, cisterns, reservoirs, springs, streams, water or water rights".

 

     5. On page 5, line 17, remove the brackets and line-through "CONDEMNATION".

 

     6. On page 5, strike lines 20 through 22 and insert in lieu thereof the following:

 

          "A. Municipalities may:

 

                (1) within the municipal boundary, acquire, contract for or condemn:".

 

     7. On page 6, strike line 4 and strike line 5 through the bracket and insert in lieu thereof the following:

 

                "(2) within and without the municipal boundary, acquire, maintain, contract for or condemn for".

 

     8. On page 6, line 7, after "inhabitants" insert "and right-of-way or other necessary ownership for the acquisition of water facilities".

 

     9. On page 6, line 8, after the paragraph designator "(3)" insert "within and without the municipal boundary,".

 

     10. On page 7, strike lines 7 through 14 and insert in lieu thereof the following:

 

          "D. Proceedings to obtain any condemnation authorized in this section shall be in the manner provided by law."".

 

     11. On page 7, line 21, after "municipality" insert "to acquire, contract for or condemn water facilities or land or to acquire or contract for water or water rights".

 

     12. On page 7, line 22, strike "and served".

 

     13. On page 8, line 7, after the period insert "No municipality may exercise the power of eminent domain under this section for reservoirs, streams, water or water rights outside the boundary of the municipality.".,

 

 

and thence referred to the JUDICIARY COMMITTEE.
