    Your CORPORATIONS AND TRANSPORTATION COMMITTEE, to whom has been referred

SENATE BILL 794, as amended

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

    1. On page 4, line 12, strike the first occurrence of "An" and insert in lieu thereof "If a one-call system is operating in the region, an". 

    2. On page 6, line 20, strike the ending quotation marks.

    3. On page 6, between lines 20 and 21, insert the following new subsection: 

         "J. The commission may prescribe reasonable maximum rates for the provision of one-call services in New Mexico, provided that if the reasonableness of such rates is contested in the manner provided by commission rule, the burden of proof to show the unreasonableness of such rates shall be upon the person contesting their reasonableness."".
