AN ACT

RELATING TO WATER; ESTABLISHING PROPERTIES AND ELEMENTS OF NATURAL WATERS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. A new section of Chapter 72, Article 1 NMSA 1978 is enacted to read:

     "[NEW MATERIAL] NATURAL WATERS--PROPERTIES AND ELEMENTS.--The physical properties of and all elements contained in natural waters within the state are part of the waters belonging to the public that are subject to appropriation for beneficial use. Physical properties and elements include physiochemical properties of water, heat contained within water, naturally occurring minerals dissolved in water, minerals or chemicals dissolved in water due to human activities and the hydrogen and oxygen that form the chemical composition of water."
