AN ACT

MAKING AN APPROPRIATION TO THE COUNTY DETENTION FACILITY REIMBURSEMENT FUND TO REIMBURSE COUNTIES FOR THE COSTS INCURRED FOR THE INCARCERATION OF FELONY OFFENDERS.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. APPROPRIATION.--Twenty-nine million seven hundred twenty-three thousand nine hundred eighty-nine dollars ($29,723,989) is appropriated from the general fund to the county detention facility reimbursement fund for expenditure in fiscal year 2009 and subsequent fiscal years to reimburse counties in New Mexico for the costs incurred by the counties for the incarceration of felony offenders. Any unexpended or unencumbered balance remaining at the end of a fiscal year shall not revert to the general fund.
