AN ACT

MAKING APPROPRIATIONS FOR TOBACCO USE CESSATION PROGRAMS AND FOR DIABETES PREVENTION, EDUCATION AND OUTREACH FROM THE TOBACCO SETTLEMENT PROGRAM FUND.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. APPROPRIATION.--

          A. Three million dollars ($3,000,000) is appropriated from the tobacco settlement program fund to the department of health for expenditure in fiscal year 2009 for tobacco use cessation programs. Any unexpended or unencumbered balance remaining at the end of fiscal year 2009 shall revert to the tobacco settlement program fund.

          B. One million dollars ($1,000,000) is appropriated from the tobacco settlement program fund to the department of health for expenditure in fiscal year 2009 for diabetes prevention, education and outreach. Any unexpended or unencumbered balance remaining at the end of fiscal year 2009 shall revert to the tobacco settlement program fund.
