SUMMARY
Synopsis of Bill
House Bill 531, making an Appropriation for Compliance with Federal Clean water Regulations
in Cibola County, appropriates $20.0 thousand from the general fund to DFA for assistance with
cleaning, deodorizing and sanitizing commercial and residential refuse containers.
FISCAL IMPLICATIONS
The appropriation of $20.0 thousand contained in this bill is a recurring expense to the general
fund. Any unexpended or unencumbered balance remaining at the end of FY09 shall revert to the
general fund.
SIGNIFICANT ISSUES
NMED notes that t
he Clean Water Act does not require cleaning, deodorizing or sanitation of refuse
containers per se. It does require storm water management at solid waste facilities. Cibola County may be
seeking funds to help it comply with storm water management requirements to control runoff from refuse
disposal areas. Any water or chemicals used in the cleaning of refuse containers must be controlled so as
not to impact the environment.
