SUMMARY
Synopsis of Bill
Senate Bill 83 appropriates $207,900 from the general fund to the eleventh judicial district court
for three full-time employees and operating expenses for a pre-trial services program. Any
unexpended or encumbered balance remaining at the end of FY 09 shall revert to the general
fund.
FISCAL IMPLICATIONS
The initial cost of the program of $207,000
in fiscal year 2009 is subject to increased costs
resulting from any increases in salaries and the costs of benefits for the five FTEs.

SIGNIFICANT ISSUES
Pre-Trial Services balances releasing offenders after arrest against potential danger to the
community and possible failure to appear. This program works closely with the court, and
reduces bed days for arrested pre-trial felons. Pre-Trial Services has been in operation in San
Juan County since 1998, and has been funded by the county. Due to budget constraints, future
funding of this program by San Juan County is at great risk. This bill would transfer the program
from county to state funding.
PERFORMANCE IMPLICATIONS
The courts are participating in performance-based budgeting. This bill may have an impact on
the measures of the courts in the following areas:
Cases disposes as a percent of cases filed
Percent change in case filings by case type
WHAT WILL BE THE CONSEQUENCES OF NOT ENACTING THIS BILL
