A JOINT RESOLUTION

GRANTING PRIOR APPROVAL TO THE PROPERTY CONTROL DIVISION OF THE GENERAL SERVICES DEPARTMENT FOR THE TRANSFER OF APPROXIMATELY TWO ACRES OF LAND AND IMPROVEMENTS IN TAOS COUNTY FROM THE GENERAL SERVICES DEPARTMENT TO THE TOWN OF TAOS.

 

     WHEREAS, Section 13-6-2 NMSA 1978 authorizes state agencies to donate real property to other state agencies, local public bodies, school districts or state educational institutions; and

     WHEREAS, a private nonprofit corporation currently provides alcoholism counseling and detoxification services in a state-owned facility that occupies approximately two acres of land held by the property control division of the general services department in Taos county; and

     WHEREAS, the two acres on which the rehabilitation facility is located is part of a parcel of land with a total of 19.430 acres situated within private claims within the Taos Pueblo grant in Taos county, being more particularly bounded and described as follows, to wit:

     "A parcel of land within private claims within the Taos Pueblo Grant, Taos County, New Mexico, containing 19.430 acres, and more particularly described, as follows: Commencing at the Southwest corner of the cemetery, in which is located the grave of Kit Carson, and which is known as the Kit Carson Cemetery, North, 58̊24' West, 383.4 feet; thence, North, 28̊40' West, 49.5 feet; thence, North, 58̊20' West, 244.5 feet; thence, North, 38̊03' East, 437.5 feet; thence, South, 69̊05' East, 304 feet; thence, North, 38̊03' East, 150 feet; thence, South, 69̊05' East, 311 feet; thence, North, 30̊42' East, 170 feet; thence, South, 69̊30' East, 393.1 feet; thence, South, 69̊25' East, 304.3 feet; thence, South, 45̊15' West, 801.2 feet; thence, South, 65̊15' West, 317.5 feet; thence, North, 60̊28' West, 193.4 feet; thence, North, 29̊04' East, 349.5 feet; thence, North, 68̊37' West, 171.6 feet; thence, South, 28̊24' West, 320.8 feet; to the point of beginning."; and

     WHEREAS, in order to maintain the facility in a clean, safe and habitable condition required to support its program, the private nonprofit corporation seeks local control and maintenance responsibility for the facility; and

     WHEREAS, the town of Taos has offered to assume ownership of the facility and the two acres of land used by the facility and to maintain the facility in a clean, safe and habitable condition; and

     WHEREAS, the town of Taos has agreed to accept the rehabilitative services provided by the program as consideration in lieu of rent; and

     WHEREAS, the property control division of the general services department has agreed to transfer ownership of the facility and approximately two acres of land used by the facility to the town of Taos, contingent on the town of Taos bearing the expenses incurred to survey, partition and transfer title of the two acres of land occupied by the program;

     NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO that the property control division of the general services department may transfer by quitclaim deed to the town of Taos a parcel of approximately two acres on which the rehabilitation facility is located; and

     BE IT FURTHER RESOLVED that the transfer of the two-acre parcel be contingent on the town of Taos bearing the expenses to survey, partition and transfer title to the town of Taos; and

     BE IT FURTHER RESOLVED that prior to the transfer, the capitol buildings planning commission shall review the transfer of the two-acre parcel; and

     BE IT FURTHER RESOLVED that copies of this resolution be transmitted to the property control division of the general services department, to the town council of the town of Taos, to the capitol buildings planning commission and to the board of directors of the private nonprofit corporation that operates the rehabilitation program in the facility proposed for transfer to the town of Taos.
