SUMMARY
Synopsis of Bill
Senate Bill 11 appropriates $25 million from the general fund to the Local Government Division
of the Department of Finance and Administration for the purpose of flood damage repair and
flood control improvements by the South Sandoval County Arroyo Flood Control Authority in
Sandoval County.
FISCAL IMPLICATIONS
The appropriation of $25 million contained in this bill is a non-recurring expense to the general
fund. Any unexpended or unencumbered balance remaining at the end of fiscal year 2009 shall
revert to the general fund. The bill contains an emergency clause.
The Authority is statutorily authorized to levy and collect general ad valorem taxes on all
property subject to property taxation within its boundaries. The tax levy or rate for general
operations is limited to one mill ($1.00 for each $1,000) on the total net taxable value of property
subject to such taxation. The Authority may issue general obligation revenue bonds subject to
the electorate at a general or special election. The revenue is budgeted for operational and debt
service expenditures. Revenues and expenditures are subject to an independent audit and require
review by the New Mexico State Auditor.

SIGNIFICANT ISSUES
The South Sandoval County Arroyo Flood Control Authority was legislatively established in
Laws of 1990, Section 72-19-1 through 72-19-103 as an independent corporate political body
with an elected board. The board of directors consists of five qualified electors to serve a six-
year term. The governor appoints members to unexpired terms until the next general election.
The board is empowered to undertake the acquisition, improvement, maintenance and operation
of flood and storm water control facilities on streams and watersheds which enter, originate or
cross the Authority’s facilities. The boundaries of the Authority are a portion of southern
Sandoval County bounded on the east by the Rio Grande, on the south by he Bernalillo and
Sandoval County lines, on the west by the top of the Rio Puerco drainage and on the north by the
top of the drainage that lies on the southern boundary of the Zia Indian reservation and State
Highway 44.
OTHER SUBSTANTIVE ISSUES
The construction of the sunset pond and Aldaba storm drain project, a component of the Black
Arroyo Watershed Management Plan for $2.6 million is currently underway. Projects recently
completed by the Authority include construction of a dam at the sportsplex and Obregon road
drainage at the Enchanted Hills Elementary School.
