AN ACT

MAKING AN APPROPRIATION FOR LOW-INCOME ENERGY ASSISTANCE PROGRAMS AND WEATHERIZATION.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. APPROPRIATION.--

          A. Twelve million dollars ($12,000,000) is appropriated from the general fund for expenditure in fiscal years 2010 and 2011 as follows to improve energy use for persons in poverty in New Mexico:

                (1) three million dollars ($3,000,000) to the human services department for the low income home energy assistance program; and

                (2) nine million dollars ($9,000,000) to the department of finance and administration for weatherization assistance through the New Mexico mortgage finance authority.           B. Any unexpended or unencumbered balance remaining at the end of fiscal year 2011 shall revert to the general fund.
