AN ACT

RELATING TO TRANSPORTATION SERVICES; CREATING THE TRANSPORTATION SERVICES DIVISION FUND AND THE TRANSPORTATION SERVICES VEHICLE REPLACEMENT FUND; REQUIRING THE TRANSPORTATION SERVICES DIVISION OF THE GENERAL SERVICES DEPARTMENT TO CHARGE STATE AGENCIES FOR THE USE OF STATE VEHICLES.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. A new section of the Transportation Services Act is enacted to read:

     "[NEW MATERIAL] FUNDS CREATED--CHARGES FOR USE OF STATE VEHICLES.--

          A. The "transportation services division fund" is created as a nonreverting fund in the state treasury. The fund consists of money received from charges paid by state agencies to the division to offset the division's costs of providing vehicles and additional services associated with vehicle and driver standards. The division shall administer the fund, and money in the fund is subject to appropriation by the legislature to carry out activities relating to the operation and control of those vehicles. Money in the fund shall be disbursed on warrants signed by the secretary of finance and administration pursuant to vouchers signed by the director.

          B. The "transportation services vehicle replacement fund" is created as a nonreverting fund in the state treasury. The fund consists of money received from charges paid by state agencies to the division to offset the costs of the depreciation and replacement of state vehicles. The division shall administer the fund, and money in the fund is subject to appropriation by the legislature to purchase state vehicles that will be controlled by the division and to carry out activities relating to the purchase of those vehicles. Money in the fund shall be disbursed on warrants signed by the secretary of finance and administration pursuant to vouchers signed by the director.

          C. The division shall charge state agencies for the use of state vehicles controlled by the division. The charges shall be reasonable and sufficient to offset the costs of the purchasing, leasing, depreciation, maintenance, operation, repair and replacement of state vehicles and shall be itemized to reflect the category of cost. The division shall deposit money received for charges attributable to the costs of operating state vehicles into the transportation services division fund. The division shall deposit money received for charges attributable to the costs of depreciation and replacement of state vehicles into the transportation services vehicle replacement fund."
