Mr. Speaker:

    Your CONSUMER AND PUBLIC AFFAIRS COMMITTEE, to whom has been referred

HOUSE BILL 616

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

     1. On page 4, line 1, after "duties", insert "for the same employer".

     2. On page 4, line 11, after "member's", insert "total aggregate".

     3. On page 5, line 7, strike "or is a district attorney" and insert in lieu thereof "; 3) the district attorney personnel review board if the affiliated public employer is a district attorney".

     4. Renumber the succeeding items accordingly.

     5. On page 5, line 23, after "member's", strike the remainder of the line and strike line 24 and insert in lieu thereof "total aggregate earnings after July 1, 2010 from the subsequent employment exceed thirty thousand dollars ($30,000),".

     6. On page 6, line 24, strike "Paragraph (8)" and insert in lieu thereof "Paragraphs (8) and (9)".

     7. On page 7, line 17, strike "or".

     8. On page 7, line 19, strike the period and insert in lieu thereof "; or" and between lines 19 and 20 insert the following paragraph:

                "(3) a retired member who is elected to serve a term as an elected official; provided that:

                     (a) the retired member files an irrevocable exemption from membership with the association within thirty days of taking office; and

                     (b) the irrevocable exemption shall be for the elected official's term of office.".,

and thence referred to the APPROPRIATIONS AND FINANCE COMMITTEE.
